Brazil Won’t Force Apple To Enable App Sideloading Despite Facing Major Scrutiny

iPhone maker Apple has been facing a serious amount of scrutiny in the past by Brazil for disabling app sideloading.

At the start of this month, a leading Brazilian judge gave the Cupertino firm just a three-month deadline to enable iOS sideloading for users in the country. Despite that call, we’re seeing things change drastically after another court ruling. This includes not forcing Apple to implement the necessary changes for now.

The news was shared with the local media outlet Estadio yesterday who confirmed the ruling done by the Federal Civil Court judge found in Brazil. They ruled out the iPhone maker could carry on distributing these apps exclusively via the App Store without enabling developers to select other apps. This is what sideloading is all about.

Last year, the Brazilian antitrust regulator dubbed Cade shared how Apple needs to enable the distribution of various apps located outside the Brazilian App Store. Therefore, the company would get just 20 days to comply with the call. On that note, the iPhone maker didn’t waste much time and appealed against the decision. This went in the company’s favor as another judge ruled that this measure wasn’t necessary at all nor was it urgent. Therefore, Apple was given more time to discuss this particular case.

A hearing with Apple was carried out in the public and various organizations such as Epic Games were included. This led the court to rule against Apple and provide them with just 90 days to enable sideloading. It felt this was necessary as the limitations put forward by the organization might jeopardize the arrival of new competition in this segment.

The court went on to claim how Apple rolled out similar types of changes across the EU without any kind of major impact or damage to the business. During that time, a spokesperson for Apple mentioned how this decision would impact privacy as well as security negatively of all iPhone users.

So as you can see, the appeal clearly had a very positive outcome for the tech giant as the Brazilian court also felt how Apple was getting punished in a manner where it appeared as if it was convicted. This is although the case isn’t closed just yet.

Now we cannot assume that Apple had come out on top. However, we can admit that this provides the company with a lot more time to prepare for what the next court has to bring forward.

One name that will not be too happy with this news is definitely Epic Games. They shared just recently how it would be rolling out Fortnite for all Brazilian Apple users in July. We must remember that the regulator in Brazil could still appeal such a decision of the court.
